These Terms of Service ("Terms") govern your purchase and use of products offered by Vladislav Alekseevich Bulgakov PE ("we," "us," or "our"), a sole proprietorship registered in the Kyrgyz Republic (INN: 20710199750028), operating as Cursor Power Desk, through the website kapibarasolutions.com.

By purchasing or using our products, you agree to these Terms. If you do not agree, do not purchase or use the products.

1. Product Description

Cursor Power Desk is a collection of digital files — including configuration files (rules), skill recipes, templates, scripts, and documentation — designed for use with the Cursor IDE. The product is delivered as a downloadable ZIP file after purchase.

The product is a software tool, not a service. It does not include consulting, coaching, or ongoing support beyond what is described in these Terms.

2. Payment and Merchant of Record

All purchases are processed by Gumroad, Inc., which acts as our Merchant of Record. Your purchase transaction, including payment processing, billing, taxes, and refunds, is handled by Gumroad in accordance with their Terms of Service and Privacy Policy.

All prices are listed in US Dollars (USD). Applicable taxes or VAT may be added at checkout by Gumroad based on your location.

3. License

Upon purchase, you receive a personal, non-exclusive, non-transferable license to use the workspace files. This license grants the following rights and restrictions:

• You CAN: Use the workspaces to create content, build websites, and run automations for yourself, your employer, or your clients
• You CAN: Modify the workspace files for your own use
• You CANNOT: Resell, redistribute, sublicense, or share the workspace files with others
• You CANNOT: Include the workspace files in another product for sale
• You CANNOT: Claim authorship of the workspace files

This license is granted for the lifetime of the product and does not expire unless terminated due to a breach of these Terms.

4. Refund Policy

We offer a 30-day money-back guarantee. If you are not satisfied with your purchase for any reason, you may request a full refund within 30 days of purchase. No questions asked.

5. Third-Party Trademarks and Disclaimers

Cursor is a product of Anysphere, Inc. We are not affiliated with, endorsed by, or officially connected to Cursor or Anysphere, Inc. "Cursor" is a trademark of Anysphere, Inc. All other trademarks mentioned on our Website belong to their respective owners.

Cursor Power Desk is an independent third-party product designed to work with Cursor IDE. Cursor IDE is a separate product with its own license, terms, and pricing.

6. No Guarantee of Results

Cursor Power Desk provides pre-configured workspace files and tools. We do not guarantee specific outcomes, income levels, time savings, or any particular results from using our products.

Results depend entirely on your use of the Cursor IDE, the AI model you have access to, your skills, effort, and individual circumstances. Testimonials or examples on our Website reflect individual experiences and are not guaranteed for every user.

7. Requirements

The product requires:

• Cursor IDE (available at cursor.com). Free tier available; Pro plan ($20/month) recommended for regular use
• A computer running Windows, macOS, or Linux
• For some features: Python (free, available at python.org)
• For some features: API keys for third-party services (OpenAI, Unsplash, etc.) — these are optional and have their own costs

You are responsible for obtaining and paying for these third-party tools and services.

8. Updates

Updates to the workspace files are provided free of charge to existing customers. We are not obligated to provide updates on any specific schedule, but we aim to keep the product current with Cursor IDE changes.

9. Support

Email support is available at info@studopolis.ru. We aim to respond within 48 business hours.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The products are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• In no event shall Vladislav Alekseevich Bulgakov PE be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use or inability to use the products.
• Our total aggregate liability shall not exceed the amount you paid for the product.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Kyrgyz Republic. Any disputes arising from these Terms shall be resolved in the courts of the Kyrgyz Republic, except where prohibited by the consumer protection laws of your jurisdiction.

Nothing in these Terms shall limit your consumer rights under the laws of your country of residence if those rights cannot be waived by contract.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the product after changes constitutes acceptance of the revised Terms.
